General Terms and Conditions

This translation is provided for information only. In case of any discrepancy, the German version prevails.

General terms and conditions of SL Handel GmbH for services offered on baubewilligt.ch. As of October 2026.

1. Service

We prepare building application documents for small buildings and installations (forms, plans, building description, enclosures), submit them to the competent authority as the property owner's authorised representative and answer follow-up questions until the first-instance decision. Scope and price are set out in the order confirmation. The law on simple agency contracts applies (Art. 394 ff. OR).

2. No legal or architectural services

We do not provide legal advice or architectural or structural design. Where cantonal law requires qualified plan authors, we bring them in; this is included in the fixed price. Objection, appeal and court proceedings are not part of the service.

3. No guarantee of success

The authority decides on the permit at its discretion. We owe a complete, formally correct dossier that meets the legal requirements, not the granting of the permit. If we find before starting the dossier that a project cannot be approved, we will tell you; in that case only the preliminary assessment is payable.

4. Client cooperation

You provide complete and truthful information, documents, photos and dimensions, grant the power of attorney, obtain the necessary consents (landowner, condominium owners, neighbours) and sign the application on time. Delays caused by a lack of cooperation extend our deadlines accordingly.

5. Prices and payment

The fixed prices published on baubewilligt.ch at the time of the order apply, payable by payment link before work on the dossier begins. Not included are authority fees, third-party expenses (land register extract, technical certificates, building profiles) and services outside the confirmed scope. Prices are in CHF and include 8.1 % VAT. Partners receive monthly collective invoices, payable within 20 days.

6. Deadlines

Stated deadlines (e.g. 5 working days) run from receipt of payment and complete documents. For retrospective applications with a deadline set by the authority, we confirm receipt to the authority on the day of the order, provided it is placed on a working day by 16:00.

7. Withdrawal

There is no statutory right of withdrawal for online services. As a goodwill gesture, you may withdraw until we start preparing the dossier, in which case the preliminary assessment (CHF 149) is charged. After that, the fixed price is due.

8. Liability

We are liable for careful performance. For slight negligence, liability is limited to the fee for the order concerned; liability for consequential damage and lost profit is excluded to the extent permitted by law. We are not liable for decisions of the authorities, the duration of proceedings, objections by third parties or the consequences of incorrect information provided by the client.

8a. Partner terms for specialist companies

Specialist companies can register their customers' projects, provided the customers have consented to their details being passed on. For each registration, the company chooses a model. Commission: the customer concludes the contract directly with us and pays the published fixed price; the company receives CHF 100 (small-structure application), CHF 150 (retrospective building application) or CHF 200 (solar special case) for each fully paid application, settled monthly. Customer discount: instead of the commission, the customer receives the same amount as a discount on the fixed price. Partner price: the company commissions us and pays CHF 490, CHF 690 or CHF 890 respectively per application against a monthly collective invoice, payable within 20 days; it invoices the application onward itself. Starter bonus: for a company's first registered project, we double the commission or customer discount. Tiers: from the 5th paid application in the calendar year, commission and customer discount increase by 25 % and the partner price decreases by 5 % (Profi tier); from the 15th paid application by 50 % and 10 % respectively (Premium tier), each rounded to whole CHF 5. The tier applies from the application with which it is reached until the end of the following calendar year; earlier applications are not adjusted retroactively. A preliminary check alone does not trigger a commission. The commission is transparent to customers and does not increase their price. There is no minimum volume; either party may end the collaboration at any time.

9. Data protection and confidentiality

Our privacy policy applies. Handovers to partners (specialist companies) take place with the end customer's consent.

10. Applicable law, place of jurisdiction

Swiss law applies. Place of jurisdiction is Zug, subject to mandatory places of jurisdiction.
