Pergola: do I need a building permit?
A classic pergola is a structure open on all sides with no fixed roof. As soon as a fixed or closable roof is added (louvres, glass, panels), it usually counts legally as a patio cover, and therefore as a building.
The dossier lead time starts once payment and all required documents have been received. Signatures and the authorities' procedure come on top. Understand the timeline.
Open pergola, fabric roof or fixed roof?
The structure, roofing, dimensions and location are decisive for classifying a pergola. Describe precisely whether it stays open, gets a retractable fabric or offers permanent protection from rain. The cantonal rules and the municipality determine the procedure for your plot.
Prepare the building application yourself or have it prepared?
Have ready for the preliminary check
- Drawing with posts, roof and any side walls
- Floor area, total height and distance to the plot boundary
- State whether free-standing or fixed to the house façade
- Photos of the location and the manufacturer's data sheet
The first enquiry is free. The site-specific preliminary check costs CHF 149 and is credited against the subsequent application.

| Canton | Classification | Rule | Legal basis |
|---|---|---|---|
| Zurich | Depends on size and location | An open pergola up to 2.5 m high and 6 m² floor area is permit-free. Larger pergolas require a permit, usually in the simplified procedure or by notification. | § 1 lit. a BVV |
| Aargau | Building permit required | A pergola over 5 m² needs a building permit, usually in the simplified procedure without profile poles or public notice. | § 49/50 BauV |
| Zug | Usually no permit required | An uncovered pergola is not a small structure and, according to the cantonal government, needs neither a building application nor a building notice. With a roof, it becomes a building. | RRB BD 2023-114, § 44a PBG |
| Lucerne | Usually no permit required | Open garden pergolas without commercial use are permit-free. As soon as a roof is added, they no longer are. | § 54 PBV |
| Bern | Depends on size and location | Permit-free as an unheated small structure up to 10 m² and 2.5 m high, if functionally part of the main building. Larger or with a roof: building application (small procedure possible). | Art. 6 para. 1 let. a BewD |
| Solothurn | Building permit required | Pergolas are not on the list of permit-free projects. If in doubt, submit a building application or ask the building authority for a preliminary assessment. | § 3ter KBV |
| Basel-Landschaft | Usually no permit required | A traditional pergola as a climbing frame needs no permit and may even stand between the building line and the road. With weather protection, it becomes a covered seating area. | § 94, § 54 RBV |
| St. Gallen | Building permit required | The administrative court classified a roofed pergola as a building; open pergolas are assessed case by case: a preliminary assessment is recommended. | Art. 136 PBG, Administrative Court B 2020/75 |
| Thurgau | Building permit required | Pergolas are not on the exhaustive list in § 99 PBG; they require a permit, usually under the simplified procedure. | § 98/99 PBG |

Frequently asked questions about pergolas
Can I put up a pergola without a building permit?
It depends on the type of construction, size, location and the cantonal and municipal regulations. Check in particular the zone, protection status and distances. Our free check is an initial assessment; in the preliminary assessment we clarify the specific location and the procedure with the competent office.
What does a building application for a pergola cost?
With us, CHF 690 fixed price for the dossier including submission and follow-up questions. Official fees and any agreed additional services are extra. You receive the scope of services before you place the order.
Is a free-standing pergola automatically permit-free?
No. Free-standing describes the structure but does not on its own decide whether a permit is required. Check the type of construction, roofing, dimensions, use and the rules for the specific location.
Should a pergola with a fabric roof be treated like a louvred roof?
This cannot be decided by the material alone. Relevant factors include whether it retracts, permanent weather protection and the local classification. Add the data sheet showing the actual roof design to the preliminary check.
How long does a pergola permit take?
Our application file turnaround is 5 working days after receipt of payment and all the necessary documents. The authority's processing is separate and depends on the procedure, requests for additional information and any objections.
What happens if the pergola is already built?
Send us any existing plans, photos and letters from the building authority. We review the next steps for the dossier and the deadlines set in the letter. Our package for retrospective building applications costs CHF 990; the authority decides on the permit.
